These General Terms and Conditions expressly regulate the conditions applicable to purchase processes carried out by users or customers for products and/or services offered by the provider, Manantial Salado, through the website https://salancestral.com/. 

These general conditions will remain valid and in effect as long as they are accessible through the website. The provider reserves the right to modify, without prior notice, both the general and specific conditions, as well as any legal texts displayed on the website. In any case, the use of the website after its modification, update, and/or replacement implies acceptance by the user.

2.1 Scope of Application: This contract regulates the contractual sales relationship between the provider and the user once the latter accepts these purchase conditions during the online contracting process by checking the corresponding box. These general conditions apply from the moment the order is placed.

The contractual sales relationship entails the delivery of a specific product in exchange for a specified price, publicly displayed on the website.

2.2 Territory of Application: The online store is active throughout the Iberian Peninsula and the Balearic Islands.

2.3 Capacity to Contract: To place an order, you must be of legal age and have the capacity to contract.

2.4 Customer Acceptance: The validation of an order through the website is carried out via email and implies the automatic acceptance of the general conditions. These conditions are available on the website https://salancestral.com/, or, if requested, we can provide them via email to the address indicated above.

The customer and all contracting processes carried out through the website are subject to the general conditions in force at the time of contracting, making it impossible to purchase any product and/or service without prior acceptance of these conditions.

All purchases made through the website, after identification and authentication using the username and password provided, will be considered validly made by the customer and, therefore, binding. The customer is solely responsible for all purchases of products and/or services made through the website using their username and password.

 

3. PARTIES INVOLVED

On one hand, the provider of the products, Manantial Salado, S.L. B-88283924, C/ Parque Tomas Caballero 2, 1º Of. 6, 31006 Pamplona, Navarra, contacto@salancestral.com (hereinafter also "the provider"), owner of the website https://salancestral.com/, presents the contractual document governing the purchase of products through the mentioned website.

On the other hand, the User - Customer (hereinafter "the User"), who participates in the purchase process by providing their contact details and making the payment. The user is responsible for the accuracy of the information provided.

By accepting this document, the user:

a. Has read, understands, and comprehends the terms outlined herein.

b. Declares that they are of legal age and have the capacity to contract.

c. Assumes all obligations set forth herein.

d. Accepts these general terms and conditions of contract from the moment they acquire any product offered.

This document may be printed and stored by Users. The provider makes available the email address contacto@salancestral.com for any queries regarding these conditions.

 

4. ACCESS AND REGISTRATION ON THE WEBSITE

Access to and browsing of the product catalogue published on the website is free and does not require user registration. To purchase products and/or contract services available on the website, registration is also not required. However, Manantial Salado reserves the right to require registration in the future, notifying the user at the time of purchase if necessary.

 

5. ONLINE PURCHASE PROCESS

The products published by the provider on the website include the available information (name, detailed description, images, price, and product availability). The online store operates 24 hours a day. If a purchase is made after 12:30 pm (Spanish time), the order will be processed the following day. Delivery times range from 24 to 72 hours, though exact times cannot be guaranteed and may occasionally exceed the estimated period. Deliveries are made from Monday to Friday, excluding public holidays.

If the provider does not have stock of a requested product, the customer will be informed, with the option to cancel the purchase and receive a refund or select an alternative product of the same value.

In compliance with Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting process follows these steps: Once the user selects the desired products, they must validate their shopping cart, which will display the selected products, their prices, and shipping costs. The user must then enter billing and shipping details and expressly accept the terms and conditions before proceeding with payment.

Accepted payment methods include PayPal and credit card.

The provider will send an email confirming the purchase, which serves as proof of purchase. Invoices will be sent by email upon request. Order confirmations and purchase receipts do not serve as official invoices.

All product prices displayed on the website are final and include VAT. Shipping costs are not included and will be specified before order confirmation. If a pricing error is detected, the provider will inform the customer immediately, allowing them to confirm or cancel the order.

Customers should check spam and junk mail folders for confirmation emails and verify that their delivery and personal details are correct.

For any errors in the order details, customers should notify the provider immediately via the contact email provided on the website.

6. PERSONAL INFORMATION

When making a purchase, Manantial Salado stores some of the customer's data to complete the transaction. All personal information is treated confidentially. Customers have the right to request access to their data and make corrections or request its deletion if needed. Manantial Salado may also use cookies to enhance the website experience. 7. PRODUCTS

Manantial Salado reserves the right to adjust prices, add additional costs, and modify product information (including images and descriptions) without prior notice. Product images and descriptions are as accurate as possible; however, variations in appearance may occur due to display settings. Images are illustrative and do not guarantee exact product characteristics.

 

8. SHIPPING CONDITIONS

Products purchased through the provider’s website will be shipped to the address specified in the order form. Cash on delivery is not available.

Shipping is free for orders over €50. For orders below this amount, shipping costs will be displayed before finalising the order.

Deliveries are handled by third-party logistics providers, and Manantial Salado is not responsible for delivery delays.

If the package arrives damaged, the customer should file a complaint with the courier service and notify the provider at the provided email.

If the recipient is unavailable at the time of delivery, a second attempt will be made on the following day, up to a maximum of two attempts.

 

9. WARRANTIES, LIABILITY AND CUSTOMER SERVICE

The right of withdrawal for purchases made through our website is recognised. You may cancel your order within a maximum period of 14 calendar days from the date of purchase. The right of withdrawal must be exercised by writing to the email address provided above.

Manantial Salado’s civil liability for the supplied products is limited to their value. The user waives the right to claim any liability from the provider for any dissatisfaction with the purchased products, as well as for potential failures, slow access, or errors when accessing the website, including data loss or other types of information that may exist on the user’s computer or network when accessing the website.

Regarding the right to warranty, all offered products have a warranty period of 3 years, in accordance with the criteria and conditions described in Royal Legislative Decree 1/2007 of 16 November, which approves the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws, except in exceptional cases where the duration may vary.

The warranty right applies only in cases of manufacturing defects and does not cover improper use of the product or normal wear and tear.

Manantial Salado shall be liable for any non-conformity issues that arise within three years from the date of delivery, provided that the user informs Manantial Salado of such non-conformity within two months from the moment they become aware of it.

No more than two months should pass between the moment the customer experiences an issue with the product and when they notify Manantial Salado. Otherwise, the product will lose its warranty. The product may only be returned if it has not been opened or used. Once used for the first time, the right to return it will be lost.

10. FORCE MAJEURE

Manantial Salado shall be exempt from liability for damages and other penalties if the execution of the contract is prevented, hindered, or delayed due to circumstances beyond our control. Factors considered as grounds for exemption include government intervention, new or amended legislation, absence of state authority, war, fire, floods, labour disputes, prohibitions, restrictions, sabotage, transport deficiencies, weather conditions, supplier failures, or criminal activities affecting the company’s operations.

11. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights, such as trademarks and copyrights appearing on the website and in published materials, are owned by Manantial Salado, its subsidiaries, or its licensors. Any use of the website or its content, including copying or storing any part of it for purposes other than personal, non-commercial use, is prohibited without the permission of Manantial Salado.

12. FRAUD

All cases of fraud will be reported to the relevant authorities. Manantial Salado reserves the right to cancel any purchase if there is suspicion of fraudulent activity.

13. MODIFICATIONS

Manantial Salado may periodically revise these Terms of Use. Whenever you place an order with us, you will be subject to the general conditions in force at the time the contract between you and Manantial Salado is formalised. Therefore, you should regularly visit this page to review the current conditions applicable to you.

14. NULLITY AND INEFFECTIVENESS OF CLAUSES

If any clause included in these General Terms and Conditions is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness shall only affect that provision or the affected part of it. The rest of the General Terms and Conditions shall remain in effect, and the provision or affected part shall be deemed as not included.

15. APPLICABLE LAW AND JURISDICTION

These terms shall be governed by and interpreted in accordance with Spanish law, except where expressly stated otherwise. The provider and the user agree to submit any disputes arising from the provision of products or services under these Terms to the Courts and Tribunals of the provider’s domicile (if a legal entity) or the user’s domicile (if a natural person).

If the user is domiciled outside Spain, both parties expressly waive any other jurisdiction and submit to the Courts and Tribunals of the city of Pamplona (Spain).
